Update on Reciprocal Tariffs

The Trump Administration announced a list of exemptions from the reciprocal tariffs that were imposed. This exemption applies to merchandise entered for consumption or withdrawn from warehouse for consumption on or after 12:01a.m. Eastern Daylight Time on April 5th, 2025.
Products include smartphones, laptop computers, semiconductor manufacturing equipment, memory chips, flat panel displays.

CBP has directed brokers/filers to correct entries as necessary to reflect the exemption. Importers may request a refund by:
· Filing a Post Summary Correction for unliquidated entries, or
· Filing a Protest for entries that have liquidated but where the liquidation is not yet final
Additional exemptions include:
· Goods of Canada and Mexico that qualify under the USMCA remain exempt from these new tariffs.
· Articles that: (1) were loaded onto a vessel at the port of loading and in transit on the final mode of transport before entry into the United States prior to 12:01 a.m. EDT on April 5, 2025, and (2) are entered for consumption (or withdrawn from warehouse for consumption) on or after 12:01 a.m. EDT on April 5, 2025, are exempt—but only through May 26, 2025.
· Articles donated by persons subject to U.S. jurisdiction intended to relieve human suffering.
· Informational materials, including but not limited to: publications, films, posters, phonograph records, photographs, microfilms, microfiche, tapes, compact disks, CD-ROMs, artworks, and news wire feeds.
· Articles from any country identified in Annex II.
· Steel and aluminum articles (and their derivatives) are exempt.
· Passenger vehicles (sedans, SUVs, CUVs, minivans, cargo vans), light trucks, and parts thereof (regardless of country of origin), that are subject to Section 232 actions, are exempt.
· Articles in which at least 20% of the value is U.S.-originating will not have the U.S. content subject to the reciprocal tariff. The reciprocal tariff will be assessed only on the non-U.S. content.
De Minimis:
President Trump has issued an executive order ending duty-free de minimis treatment for low-value imports from China (including Hong Kong; Macau could be added later). This change will be effective for goods entered or withdrawn from warehouse for consumption on or after 12:01 a.m. EDT on May 2. Goods from China sent through means other than the international postal network that are valued at or under $800 and would otherwise qualify for the de minimis exemption will be subject to all applicable duties (Section 301 tariffs, reciprocal tariffs, etc.), which must be paid in accordance with applicable entry and payment procedures.
